J.C. Penney Co., Inc. (NYSE: JCP) CEO Ron Johnson is testifying again in the Macy's (NYSE: M)/Martha Stewart Omnimedia (NYSE: MSO) case this morning.
Johnson said, in part, he wouldn't have entered a contract "if Macy's deal was breached."

According to its most recent Q4 report, the situation at J.C. Penny (NYSE: JCP) has gone from bad to worse. This is illustrated by a dramatic fall in comps, which declined 32 percent. According to analysts at Gilford Securities, there is no reason for investors to become bullish at this time, and the risk of failure is increasing.
