Netlist files ITC complaint against Micron over patent claims

Netlist, Inc. (OTCQB: NLST) has filed a complaint with the U.S. International Trade Commission (ITC) alleging patent infringement by Micron, Supermicro, HPE, and Lenovo, according to a company statement released Aug. 12, 2026.

The ITC complaint cites infringement of four Netlist patents: U.S. Patent Nos. 10,025,731, 10,217,523, 12,373,366, and 12,675,407. Netlist is seeking exclusion and cease and desist orders to block the import of allegedly infringing memory products into the United States. The patents at issue relate to DDR5 RDIMMs and MRDIMMs.

Separately, Netlist filed a patent infringement lawsuit against Micron in the U.S. District Court for the Central District of California, asserting two of the same patents: Nos. 10,217,523 and 12,675,407.

C.K. Hong, Netlist's chief executive officer, said, "While its major competitors have licensed Netlist patents for many years, Micron continues its unauthorized use of Netlist technology to gain an unfair competitive advantage and reap historical profits."

ITC proceedings typically progress to trial within one year. Netlist is represented by Latham & Watkins, Sterne Kessler Goldstein & Fox, and Irell & Manella.
