The first substantive court test of the ethylene damages has gone in Clariant's favour, with Amsterdam finding insufficient evidence that the infringement influenced the MCP. While ~€10bn of claims remain outstanding, including ~€6.4bn before German courts (that remain free to reach different conclusions), litigation risk, in our view, is meaningfully reduced.
