Notice of Termination of Court Proceedings
Pursuant to the out-of-court settlement agreement concluded between AS Tallinna Vesi and Tallinn University of Technology on 9 October 2026, the Supreme Court of Estonia (Riigikohus) today accepted the application for waiver of the claim filed by Tallinn University of Technology on 12 October 2026 in civil case No. 2-22-10417, set aside the judgments previously rendered in the matter by the lower courts, and terminated the proceedings.
In the view of Tanel Kalaus, legal representative of Tallinna Vesi, today’s ruling is an important and most welcome step towards final resolution, which would allow all parties to devote their energy to their core activities rather than to litigation. “Although this particular dispute began as early as 2022 (and other similar disputes a couple of years earlier still), it had not progressed beyond the interim judgment stage. The disputes have also raised questions concerning the interrelationship between water sector regulation and competition law, in respect of which several expert economic opinions have been submitted and a request has been made to refer questions to the Court of Justice of the European Union for a preliminary ruling. This shows that the dispute is complex and costly, both legally and economically, and that no final determination by the courts could be expected in the coming years. For that reason, Tallinna Vesi began seeking a reasonable compromise as early as the beginning of the summer. Negotiations are ongoing, and it is hoped that a final out-of-court resolution of the other court disputes concerning the price of water services is not far off.”
The Company intends to settle all other pending court cases based on claims for the tariff difference on similar principles. Proposals to that effect have been made to the parties concerned, and negotiations are currently ongoing.
