How Personal Legal Representation Is Changing the Timeshare Exit Model

September 9, 2026 4:55 PM EDT

Miami Herald article highlights an important distinction for timeshare owners: attorney involvement does not necessarily mean the attorney represents the consumer.

PHOENIX, Sept. 9, 2026 /PRNewswire/ -- A recent article published in the Miami Herald is drawing attention to an increasingly important issue in the timeshare exit industry: the difference between a company advertising attorneys and a consumer actually having an attorney who personally represents them.

Newton Group is the #1 Trusted Name In Timeshare Exit

The article, "A Changing Approach to Timeshare Exit," examines Newton Group and the changing role legal representation can play for timeshare owners seeking to end unwanted ownership.

For Newton Group founder and CEO Gordon Newton, the distinction comes down to one simple question:

Who does the attorney actually represent?

"Consumers hear phrases like 'attorney-backed,' 'attorney-led,' 'attorneys on staff' or even references to a law firm, and they understandably assume that means an attorney represents them," Newton said. "But attorney involvement and personal legal representation are not the same thing. What matters is whether the consumer actually establishes an attorney-client relationship with a lawyer whose legal and ethical duties are owed to them."

That distinction has become central to Newton Group's approach to timeshare exit.

Newton Group and DC Capital Law have common ownership, but each Newton Group client separately establishes an attorney-client relationship with the law firm in which the attorney represents the timeshare owner — not Newton Group.

Newton Group is not a law firm and does not provide legal advice. Legal services are provided pursuant to the client's separate attorney-client engagement.

Each client is personally represented by a licensed attorney and receives a written Letter of Representation confirming that relationship.

According to Newton:

"Attorney involvement does not answer the question. An attorney-client relationship does."

That distinction can be particularly important in an industry where consumers are often asked to sign another legally binding agreement after already struggling with the consequences of their timeshare contract.

Newton encourages consumers comparing timeshare exit companies to look beyond marketing terminology and ask several basic questions before signing:

  • Does an attorney actually represent me?
  • Will I sign a separate attorney-client agreement?
  • Will I receive written confirmation that the attorney represents me?
  • Who does the attorney owe a legal and ethical duty to?
  • Does the lawyer represent my interests, or the interests of the exit company?
  • Are legal services guaranteed as part of my agreement, or merely available if the company later decides they are necessary?

"Sharing a name with a law firm, employing attorneys or advertising that lawyers are involved does not by itself establish personal representation," Newton said. "Consumers should read the actual agreement and determine exactly what legal relationship is being created."

The issue matters because choosing an exit provider can itself create significant risk.

The ongoing Newton Group Timeshare Exit Study, which has examined more than 10,000 timeshare ownership experiences, found that 55% of respondents reported failing at least once in an attempt to exit their timeshare. Among those who failed, more than one in four said the exit company they hired was the reason.

"The consumer already had to trust a salesperson once when buying the timeshare," Newton said. "The answer should not be asking them to blindly trust another salesperson when trying to get out."

Newton Group built its model around removing that blind trust.

Since focusing on timeshare exit in 2005, Newton Group says it has helped more than 30,000 families pursue solutions to unwanted timeshare ownership. The company is BBB Accredited with an A+ rating and has twice been named a finalist for the BBB Torch Award for Ethics.

Its business structure also allows Newton Group to combine timeshare exit services and personal legal representation while reducing the duplicated costs and outside legal markups common in traditional models.

Newton Group backs that model with its Best Price Guarantee: bring the company a quote from a standard timeshare exit company, and Newton Group says it will beat that price by 20% or more, subject to applicable terms and qualification requirements.

"You might expect personal legal representation and greater protection to cost more," Newton said. "Our structure was specifically designed so it does not."

Newton believes that is ultimately the larger significance of the Miami Herald article.

The timeshare exit conversation is beginning to move beyond whether lawyers are somehow involved and toward a much more meaningful question about the actual relationship between the lawyer and the consumer.

"For consumers comparing timeshare exit companies, this may be the most important question they can ask," Newton said.

"Who does the attorney actually represent?"

Not the exit company.

Not the sales rep.

Not the resort.

The right answer is - The timeshare owner.
