ITC upholds GoPro patent ruling, blocks Insta360 camera imports

The U.S. International Trade Commission upheld an administrative law judge's ruling that Insta360 imported and sold products in the United States that infringe on GoPro Inc. (NASDAQ: GPRO) patents, according to a company statement.

The ITC confirmed that Insta360's action camera products infringe GoPro's design patent for its HERO camera. The commission issued a Limited Exclusion Order to U.S. Customs and Border Protection to prevent further importation of Insta360's products, as well as a Cease and Desist Order prohibiting Insta360 from importing, selling, and marketing the products. The orders will take effect after Presidential Review.

The ruling follows an initial determination issued July 11, 2025. The Patent Trial and Appeal Board also upheld the validity of multiple GoPro utility patents late last year, rejecting three separate Insta360 challenges to patents covering GoPro's HyperSmooth technology.

"Innovation is at the heart of everything we do at GoPro. When competitors imitate instead of innovate, we have no choice but to take action to ensure creators everywhere benefit from products built on original ideas, not imitation," said Nicholas Woodman, GoPro's founder and CEO.

GoPro holds more than 1,500 U.S. patents, according to the press release statement.
