Investing.com -- The Commodity Futures Trading Commission unveiled an Advanced Notice of Proposed Rulemaking on Monday aimed at establishing a tailored regulatory framework for leveraged digital asset transactions offered to retail investors. The initiative draws on the agency’s existing authority under section 2(c)(2)(D) of the Commodity Exchange Act to integrate crypto trading into its national market structure, opening a 60-day public comment window to shape future formal rules.

The proposed framework would create a dedicated registration subcategory known as a "crypto asset market" for platforms facilitating leveraged, financed, or margin trades. By codifying industry standards and expanding regulatory oversight, regulators seek to establish proactive compliance safeguards designed to prevent fraudulent schemes before they occur rather than relying strictly on post-hoc enforcement.

“The American people deserve clarity, certainty, and consumer protections in the crypto asset markets and the agency is committed to delivering this by incorporating crypto asset transactions into its uniform national market regulatory framework,” CFTC Chairman Michael Selig said in a statement. He added that the announcement fulfills administrative directives to build a comprehensive federal market structure using existing statutory tools.

The administrative push follows legislative stagnation in Congress, where a bipartisan coalition recently stalled the broader Clarity Act. That legislation would have explicitly granted the CFTC statutory oversight over digital assets classified as commodities, prompting regulators to leverage current legal frameworks instead of waiting for comprehensive congressional action.

While executive actions lack the permanent standing of federal legislation, the Trump administration expects rapid commercial adoption will anchor these rules into industry practices, raising the threshold for future regulatory reversals. Joint commitments between the CFTC and the Securities and Exchange Commission further underscore a coordinated administrative strategy to modernize market architecture without lingering on stalled legislative proposals.

Major digital asset venues stand directly in the path of the proposed registration regime. Major platforms including Coinbase Global Inc (NASDAQ: COIN) and Crypto.com currently facilitate leveraged consumer trading, while Robinhood Markets Inc (NASDAQ: HOOD) prepares to roll out crypto perpetual futures featuring up to 10-times leverage on select contracts.

Under the agency's proposal, venues seeking to host perpetual futures or prediction markets retain the option to register under standard designated contract market rules. The flexibility signals an effort to accommodate emerging derivatives and event-driven instruments within existing institutional frameworks while establishing specialized channels for leveraged spot retail products.
