TikTok enforcement delay extended to December 16, 2025
President Donald Trump extended the enforcement delay for the Protecting Americans from Foreign Adversary Controlled Applications Act as it applies to TikTok until December 16, 2025, according to an executive order issued today.
The order marks the third extension of the enforcement delay, following previous extensions in April and June 2025. During this period, the Department of Justice will not take action to enforce the Act or impose penalties against any entity for noncompliance, including activities related to distributing, maintaining, or updating foreign adversary controlled applications as defined in the legislation.
The executive order specifies that the Department of Justice will not pursue enforcement actions for any conduct that occurred during the delay period or before the order's issuance, including the timeframe from January 19, 2025, until the current order's date.
The Attorney General has been directed to issue written guidance implementing these provisions and to send letters to each provider stating there has been no violation of the statute and no liability for conduct during the specified periods.
The order also addresses enforcement authority, stating that because of national security interests and the Act's provision granting exclusive enforcement authority to the Attorney General, attempted enforcement by states or private parties represents an encroachment on executive powers. The Attorney General has been instructed to preserve and defend this exclusive federal enforcement authority.
The Protecting Americans from Foreign Adversary Controlled Applications Act was enacted as Public Law 118-50, Division H, and specifically targets applications controlled by foreign adversaries.
